RESOLVING DISPUTES IN THE WORKPLACE

  • Disputes between individuals in the workplace can have a devastating effect, not only on the staff involved but often on the business as a whole. Mediation offers a valuable opportunity to avoid damaging tribunals or expensive legal action.

  • Workplace disputes are often complex and our process helps establish whether mediation is the most appropriate option before we arrange a mediation session. In particular, we need to ensure that the parties are all agreeable to participate voluntarily.

  • If everyone involved agrees to speak to the mediator, he will meet individually and confidentially with each person to ascertain the issues and to identify possible solutions. The mediator will only pass on information to another party if specifically authorised to do so. These discussions will also enable the mediator to assess whether mediation is suitable or whether an alternative approach is needed.

  • If the parties still wish to continue, and mediation is considered a suitable option, the mediator will then convene a confidential meeting of the people involved in the dispute to finalise an agreement on taking matters forward. The main points will be summarised in a written document for the parties to sign.

  • The mediator will then report the outcome to the principal client contact and, subject to the consent of the participants, any relevant points of agreement. The content of the discussions will remain confidential.

The earlier mediation is used, the more effective it will be.
